UK FCA to Allow Retail Investors Access to Crypto ETNs in 2025

The Financial Conduct Authority (FCA) of the United Kingdom will lift its ban on exchange-traded notes backed by cryptocurrencies (cETNs) for retail investors starting October 8, 2025. The move ends a restriction that has been in place since January 2021. The FCA aims to expand investment options for individuals while maintaining strict protective measures for consumers.

Key Regulatory Changes

The FCA's updated policy allows retail investors to access cETNs, provided these products are traded on a recognized investment exchange (RIE), such as Cboe or the London Stock Exchange. Companies offering the notes must adhere to new financial promotion rules. These regulations require providers to deliver clear information and prevent inappropriate investment incentives for retail clients.

Investor Protections and Limitations

While cETN transactions will be subject to the Consumer Tax, these products will not fall under the Financial Services Compensation Scheme (FSCS). This means that in the event of an issuer's insolvency, retail investors would not have access to compensation.

David Geale, the FCA�s executive director for payments and digital finance, said the market has changed since the initial ban. Geale noted that crypto ETNs have become more widespread and better understood. "We are offering consumers more choice while ensuring appropriate safeguards. People should have the information necessary to judge if the level of risk is right for them," Geale stated in the FCA�s announcement.

Regulatory Timeline and Context

This change follows a phased approach by the FCA. In March 2024, the authority enabled professional investors to access cETNs through specific market segments. In June 2025, it launched a public consultation on expanding access to retail investors. The original ban, introduced in January 2021, restricted the sale, marketing, and distribution of crypto-referenced derivatives and ETNs to the public, citing concerns about volatility and investor understanding.

Despite this new allowance, the FCA will maintain its ban on retail access to crypto derivatives.

Market Impact

With the October 2025 implementation, local exchanges are expected to expand their cETN offerings. Analysts suggest the move could attract hundreds of millions of pounds in retail inflows over the coming months. This development comes amid growing retail interest in cryptocurrencies in the UK, where demand increased by 45% in the past year, supported by the recovery of key assets such as Bitcoin and Ethereum.

The FCA's decision marks a significant step in the UK's evolving regulatory landscape for digital assets, balancing expanded access with consumer protection.
