Binance has requested that a Delaware bankruptcy court dismiss a lawsuit filed by FTX, which aims to recover $1.76 billion in funds transferred between the two crypto firms under uncertain circumstances. This legal effort highlights ongoing fallout from FTX's high-profile collapse and the ripple effects that continue to impact the crypto industry.

Arguments Around Jurisdiction

According to a recent filing, Binance�s founder and former CEO Changpeng �CZ� Zhao argued that the case should be dropped due to jurisdictional issues. Zhao, who resides in the United Arab Emirates, claims that the transactions in question did not take place in the US. He contends that US bankruptcy statutes do not apply to the transfer, since it involved foreign jurisdictions and parties outside the United States.

The legal team for Zhao also described him as a �nominal counterparty� in the transaction, emphasizing that the business relationship between FTX and Binance was limited. Zhao argues that Delaware is not an appropriate venue for the legal dispute.

Longstanding Tensions Between Binance and FTX

The FTX-Binance relationship has been contentious. In 2023, FTX accused Zhao of making social media statements that damaged its reputation. Prior to that, in 2022, Binance and FTX faced off in British courts, with Zhao still at Binance�s helm.

After FTX�s collapse, founder Sam Bankman-Fried was accused by creditors and stakeholders of causing the liquidity crisis leading to the exchange's closure. FTX�s lawsuit, filed last year, alleges that Bankman-Fried misused company funds and transferred $1.76 billion to Binance before operations ceased. The suit has seen limited progress since its inception.
